Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the lift equipment failure and struck-by hazards
a truss beam.
On or about December 2, 2010, at 6913 FM 518, Pearland TX, 77581,
employees used a
Genie SLC-24 Super lift to lift and move a wooden truss beam in position
to construct an
entryway. The employees exceeded the Superlift rated capacity by lifting a
truss beam that
weighed in excess than the lift was designed for, exposing employees to
failure of the lift and
struck-by hazards from the beam.
Among other methods, one feasible and acceptable abatement method is to
read and comply
with the Genie Superlift Contractor Operators Manual Safety Rules.
Do Not Operate Unless:
a)You learn and Practice the principles of safe Machine operation
contained in the
operator's manual.
1. Avoid hazardous situations. Know and understand the safety rules before
going on to the
next section.
2. Always perform a pre-operation inspection.
3. Always perform the function tests prior to use.
4. Inspect the workplace.
5. Only use the machine as it was intended.
b) You read, understand and obey the manufacturer's instructions and
safety rules-safety and
operator's manuals and machine decals.
You read, understand and obey employer's safety rules and worksite
regulations. You read,
understand and obey all applicable governmental regulations.
You are properly trained to safely operate the machine.
c) In addition:
Do not exceed the rated load capacity. See Load Capacity Charts section.
Do not cause a horizontal force or side load to the machine by raising or
lowering a fixed or
overhanging load
Do not stand under or allow personnel under the machine when the load is
raised.
