Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer failed to ensure that a boom-supported elevating work platform's safety device was not disabled, as follows: a.At the Heritage Park construction site, fire protection and pool installation activities, employees were exposed to struck-by and/or crushing hazards while working proximally to a boom-supported elevating work platform, or aerial lift with a disabled back up alarm safety device. Reference: ANSI/SIA A92.5-1992 for Boom-Supported Elevating Work Platforms 7.3.3 Pre-start inspection: Before use each day or at the beginning of each shift, the aerial platform shall be given a visual inspection and functional test including but not limited to the following:...b) Safety devices... 7.11.4 Altering safety devices: Altering or disabling of interlocks or other safety devices shall be prohibited. 8.4 Problems of malfunctions: Any problems or malfunctions that affect the safety of operations shall be repaired prior to the use of the aerial platform. One feasible means of abatement would be to perform the pre-start inspection before each use to ensure all safety devices are enabled and functioning correctly by testing the operation thereof.n
