Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
were exposed to polymer dust explosions, deflagrations, or other fire
hazards because methods
were not utilized to ensure proper collection of and prevent ignition of
combustible polymer dust
during generation and collection operations.
a.Simcote, Inc. located in Marian, Ohio:  On or about March 23, 2011, the
dust collection
system located adjacent to the coating line contained the following
hazards:
1.The dust collector was not equipped with deflagration protection;
2.The duct work leading to the coating storage bin was not constructed out
of
noncombustible materials;
3.The dust collector was not located outside;
4.The dust collector was not vented to the outside and was allowed to
recycle air
back into the facility.
Abatement Note: Among other methods, one feasible and acceptable abatement
method to
correct this hazard is to comply with National Fire Protection Association
(NFPA) 654-2006
Standard for the Prevention of Fire and Dust Explosions from the
Manufacturing, Processing,
and Handling of Combustible Particulate Solids", including, and NFPA
91-2010 "Standard for
Exhaust Systems for Air Conveying of Vapors, Gases, Mists, and
Noncombustible Particulate
solids", but not limited to: a) Install a deflagration detection and
suppression system in
accordance with Chapter 7 of NFPA 654. b) Ensure all duct work is metal
according to Chapter
7 of NFPA 654 and Chapter 4 of NFPA 91. c) Ensure the dust collector is
located outside
according to Chapter 7 of NFPA 654. d) Ensure the dust collector does not
recycle
air back into
the facility according to Chapter 6 of NFPA 654.
Step 1: Within 30 days submit to the Area Director a written, detailed
plan of abatement
outlining a schedule for the implementation of engineering and/or
administrative measures to
control employee exposure to hazardous substances as referenced in this
citation.  This plan shall
include, at a minimum, target dates for the following actions which must
be consistent with the
abatement dates required by this citation:
1. Evaluation of engineering /administrative controls options;
2. Selection of optimum control methods and completion of design;
3. Procurement, installation and operation of selected control measures;
and
Must be completed by 08/23/2011Step 2: Abatement shall have been completed
by the implementation of feasible engineering
controls upon verification of their effectiveness in achieving compliance.
Must be completed by 10/04/2011
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your
certification.  This documentation may include, but is not limited to,
evidence of the purchase
or repair of the equipment, photographic or video evidence, or written
records.
