Nevada Revised Statute 618.375(1):  Duties of employers.  The employer
failed to furnish
employment and a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm to his employees:
The employer failed to ensure that the safety precautions of the
manufacturer's self-propelled
elevating work platform, or scissorlift, were adhered to as follows:
a.At the Ruby Duncan Elementary School jobsite located at 250 West Rome,
North
Las Vegas, an employee with Skyline Steel was observed climbing over the
scissorlift rails to access the scissorlift, to be lowered to the ground
from a height
of approximately 18 feet from the low rise roof.  The employee had no fall
protection equipment in his possession when he was lowered from the roof.
The
gate of the scissorlift was facing away from the low rise roof edge.  Also,
CSHO's contacted the foreman and requested that the employee come down for
an interview and the CSHO's waited at least 30 minutes before the employee
came down from the two roofs.

Section 1 Safety Precautions 1.1 GENERAL Pg. 1-1:
Ensure that the machine is to be used in a manner which is within the
scope of its intended
application as determined by JLG
Section 1.3 OPERATION Pg.1-2:  Keep both feet firmly positioned on the
platform at all times.
Section 1.3 OPERATION Pg. 1-3:  Use extreme caution when entering or
leaving platform.
Ensure that the scissor arm assembly is fully lowered.  Face the machine
when entering or
leaving the platform.  Always maintain "three point contact" with the
machine, using two hands
and one foot or two feet and one hand at all times during entry and exit.
Platform-to-structure transfers at elevated positions are discouraged.
Where transfer is
necessary, enter/exit through the gate only with the platform within 1
foot(.3m)
of a safe and
secure structure.  100tie-off is also required in this situation
utilizing two lanyards.  One
lanyard must be attached to the platform with the second lanyard attached
to the structure.  The
lanyard connected to the platform must not be disconnected until such time
the transfer to the
structure is safe and complete.
