North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall to lower level: a)establishment, outside peat moss storage area, open side 5 feet 7 inches above the adjacent ground level - no standard guard railing was provided. Amoung other methods, one feasible and acceptable abatement method would be to erect a standard guard rail system along the open side.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards: a)establishment, outside above ground LP gas tank - the tank was not protected from vehicular traffic. Abatement note: One feasible and acceptable method to abate this hazard is to install perimeter barriers to protect the tank from vehicular traffic in accordance with NFPA 58 Chapter 14 (2) physical protection.
