Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: burns and fire hazard while operating utility boilers
without addressing
defects/deficiencies noted during internal inspections:
(a)On or about April 5, 2011, in building #10 employees were exposed to
fire and/or
explosion hazards when the employer did not ensure the discrepancies found
during the
employees walk-around inspections from 2010 through 2011 were addressed in
a timely manner.
One feasible and acceptable method to correct this hazard would be to
comply with the
National Fire Protection Association 85 (NFPA 85) Boiler and Combustion
Systems Hazards
Code, Sections 4.4.1.1 through 4.4.1.7 which requires the owner-user to
provide an
inspection and maintenance program.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or other
written records.
