Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about May 20, 2010, and at other times prior thereto, at the PVC Waste Powder Warehouse, employees working and walking adjacent to structurally compromised steel building walls were exposed to struck-by hazards. Among others, one feasible means of abatement would include a) applying temporary strapping to prevent further dislodging and sudden movement, b) removing stored materials away from the areas, and c) flagging and establishing a controlled access zone in the immediate vicinity.
