Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from an improperly used and unstable ladder in the barge assembly area of the shipyard while constructing a portion of a barge hull. Among other methods one feasible and acceptable abatement method to correct this hazard is to use the ladder in accordance with manufacturers instructions as described by fully extending the ladder and place all four legs flatly on the working surface as referenced in American National Standards Institute (ANSI) A14.5 1992 9.3.1 Ladders- Portable Reinforced Plastic-Safety Requirements. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by crane loads or other debris due to the cab not having a protective window while operating a 150 Ton Manitowoc Crawler Crane that was located in the assembly area of the shipyard. Among other methods, one feasible and acceptable method to correct this hazard is to install a window in the front of the cab as per ASME B30.5-2007 Section 5-1.8.1(b) Mobile and Locomotive Cranes. Among other methods, one feasible and acceptable method to correct this hazard is to repair or replace the jib where corrosion and deformation has occurred in accordance with the American Society of Mechanical Engineers (ASME) B30.5-2007 5-2.3.3 Mobile and Locomotive Cranes.
