Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were exposed to crushing and struck-by hazards: a) On or about October 27, 2010, and at times prior employees were exposed to crushing and struck-by hazards while they used slings and other rigging hardware, such as shackles, to attach wind turbine tower sections to Kalmar Reach Stackers without first receiving training in the safe use of the slings and rigging hardware. Both ASME B30.26 (Rigging Hardware) and ASME B30.9 (Slings) require training in areas such as selection, inspection, cautions to personnel and the effects of the environment for employees using this type of equipment. Abatement: Among other methods, one feasible and acceptable abatement method to correct the hazard is to provide the training required by ASME B30.26 and ASME B30.9 to all employees involved in rigging to ensure that rigging equipment is used in an appropriate and safe manner. Abatement Note: Abatement documentation and certification is required for this item (see enclosed "Sample Abatement-Certification Letter").-Certification
