North Carolina General Statute 95-120(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: fire and explosion hazards due to the subsequent flame and pressure front that would be transmitted through the return air ducts into the plant: a)fabrication shop - where an outdoor dust collector that captured combustible class II dust from employees cutting wood products or particle board that did not meet the processes and operations for woodworking facilities on or about July 26, 2011. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct these hazards was to demolish the discharge duct back into the building and allow this air to vent outdoors; to comply with the National Fire Protections Association (NFPA), 664 standard for the "Prevention of Fire and Explosions in Wood Processing and Woodworking Facilities" Chapter 8, Section 2.2.6 which states, "Recycling exhaust air shall not be recycled back in the building." Exceptions are listed which permit the recycling of exhaust air: 1. For collection systems with a capacity less than or equal to 5,000 cfm (cubic feet per minute) the system shall be equipped with a spark detection, designed and installed in conformance of NFPA 72. 2. For collection systems with a capacity greater than 5,000 cfm (cubic feet per minute) the collection system shall be protected by a spark detection system, a high speed abort gate activated by the spark detector and the abort gate is provided with a manual resetl
