Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of being struck-by:
a)Budget Air Hoist, Serial Number 920852, Model 311532506,
Primer Room: On or about August 31, 2011, and times prior
thereto, employees were exposed to struck by hazards due to a
missing latch on the hook and failure to conduct frequent and
periodic inspections of the underhung overhead hoist.
b)Shawbox Hoist, Serial Number 00B21720, Model 72L05026S151R, Entrance of
Paint Line: On or about August 31, 2011, and times prior thereto, employees
were exposed to struck by hazards due to a leaking hoist gear box,
defective load
brake on the up functions, leaking trolley gearbox, defective and worn
gearing
teeth and pinions on the bridge drive wheels, and failure to conduct
frequent and
periodic inspections of the overhead floor operated crane.
c)Shawbox Hoist, Serial Number 04A26775, Model 72L07022S14,
Paint Line: On or about August 31, 2011, and times prior thereto,
employees were exposed to struck by hazards due to a damaged
latch on the hook, leaking gearbox, defective load brake on the up
functions, damaged cord that connects to the pendant control,
defective and worn trolley idler wheels, rail sweeps that are in
contact with the bridge, and failure to conduct frequent and
periodic inspections of the overhead floor operated crane.
One feasible and useful method to correct the hazard is to ensure a
preventive hoist maintenance
program is in place and defects are promptly and properly abated in
accordance with ASME
B30.16, Overhead Hoists, Chapter 16-1 "Marking, Construction, and
Installation" Chapter 16-2,
"Inspection, Testing, and Maintenance" and Chapter 16-3, "Operation".
