North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to fire and explosion hazards:
a)storage silos - the two exterior storage silos were not provided with
explosion
protection, such as but not limited to deflagration venting.
b)flour distribution loop - the flour distribution loop was not provided
with
explosion protection, such as but not limited to deflagration isolation
protection.
c)flour distibution loop - the flour distribution loop was not provided
with a
continuous conductive surface.
Among other methods, one applicable and feasible method to correct these
hazards is to comply
with National Fire Protection Association (NFPA) 61, "Standard for the
Prevention of Fires and
Dust Explosions in Agricultural and Food Processing Facilities", 2008
Edition.
Note: The design of fire and explosion safety provisions shall be based on
a thorough process
hazard analysis of the facility, the process and the associated fire and
explosion hazards.
