Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by the load being lifted by a mobile crane due to failure of the mobile crane operators and their respective riggers to use standard or universal signals as a means of communications. ABATEMENT NOTE: Among other procedures, one feasible and acceptable abatement method to correct the hazard is for the employer to come into compliance with the American National Standard Institute (ANSI) Safety Standards for Mobile Cranes, ANSI B30.15-1973, Section 15-3.3 Signals which states: "Standard signal to the operator shall be in accordance with the standards prescribed in Paragraph 15.3.3.2, unless voice communication equipment (telephone, radio or equivalent) is utilized. Signals shall be discernible or audible at all times. No response shall be made unless signals are clearly understood." Disclaimers: You are not limited to the abatement methods described above.
