HAR 12-60-2(a)(3): Every employer shall provide safe work places and practices by elimination or reduction of existing or potential hazards. Elimination of existing or potential hazards by design, process substitution, or other appropriate methods is preferred because it eliminates the need for further employee protection. When elimination is not feasible, reduction of existing or potential hazards to acceptable levels, using methods such as engineering or administrative controls, isolation, or guarding, shall be promptly used. When these methods are inadequate to reach acceptable levels, personal protective equipment shall be provided and used. Hawaii State Hospital at the Kaneohe facility location - The employer did not furnish employment free from recognized hazards that were likely to cause death or serious physical harm in that their employees were exposed to the hazard of being physically assaulted by their own patients. Aggressive and unstable patients have assaulted and/or attempted to assault employees on the average of once every three days causing serious physical injuries.

Hawaii State Hospital at the Kaneohe facility location - Seven transportation vehicles (six vans and one sedan) did not have partitions or barriers between the patients and the drivers in order to prevent assaultive acts against the drivers and the loss of control of the vehicles while they were being operated.

Hawaii State Hospital at the Kaneohe facility location - Hawaii State Hospital accepted aggressive and unstable patients from the Hawaii State Judiciary and from the Hawaii State Department of Public Safety although these patients were not accompanied by orders to treat. Aggressive and unstable patients have assaulted and/or attempted to assault employees on the average of once every three days causing serious physical injuries.
