Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing and struck-by hazards:
In the following instances, the employer did not comply with the American
National
Standard Institute - Automotive Lift Institiute, Inc. (ANSI/ALI ALOIM)
2000 and ANSI
B153.1-1981 when using the Benwil TP-7 automotive lift:
a)Section 4.2 Operator training - The owner or employer did not ensure that
operators of automotive lifts were instructed in the safe use and
operation of the
lift using the manufacturer-provided instructions and warning labels and
the
Automotive Lift Institute publications, "Quick Reference Guide, Vehicle
Lifting
Points for Frame Engaging Lifts", "Lifting It Right", "Safety Tips", and
the
ALOIM Standard.
Garage - The mechanics were not properly trained to use the Benwil TP-7
automotive lift.
b)Section 4.4 Operator Responsibilities - The lift owner or employer did
not take
all appropriate steps to follow the recommended inspection procedures of
the lift
manufacturer, but in no event shall the lift operator fail to inspect or
take notice
of the following features on a daily basis which also included the proper
operation
of the lift controls, restraints, and locking devices.
Garage - The appropriate steps were not taken to inspect the Benwil TP-7
automotive lift.
c)5.6.2.16 Inspection points-All Lifts - On lifts employing a continuous
locking
system, the employer did not check to ensure that the lift locks were
operational
and engaged in all the intended points.
Garage - The employer did not check to ensure that the lift locks were
operating
and engaging in all the intended points.
One feasible means of abatement is to follow the guidelines set forth from
the
manufacturer and ANSI Standard for Automotive Lifts, 2000 Safety
Requirements for
Operations, Inspection, and Maintenance.

In the following instances, the employer did not comply with ASME B30.16
when using
the 5 ton P&H gantry crane's 6600 pound overhead electrical chain hoist:
a)Section 16-2.1.2 Frequent Inspection and Section 16-2.1.3 Periodic
Inspection.
Garage -  The 6600 pound hoist had not been frequently and periodically
inspected.
b)Section 16-1.3 Installation: When a hoist is suspended from a trolley
and crane
and the rated load of each piece of equipment is different, the rated load
for the
system utilizing this combination of equipment was not based on the lowest
minimum rated load of any individual piece of equipment or structure
within the
system.
Garage - The overhead electrical chain hoist was rated at 6600 pound
capacity
while the gantry crane structure was rated for 5 tons.
A feasible method to abate the hazard is to utilize the services of a
crane professional to
evaluate and inspect the crane and hoist in accordance to the manufacturer
and ASME
B30.16.
