Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:On or About 07/01/14 Location:Gravity Belt Thickener Tank Condition:Employees were exposed to a fall hazard of approximately 25 feet when climbing over and through a guardrail in order to access a portable metal extension ladder extending between the catwalk and the floor of the empty tank. Among other methods, feasible means of abatement could include but are not limited to: ensuring that the area around the top and bottom of the ladder is kept clear; ensuring that ladder side rails extend at least one foot above the upper landing surface; ensuring that the user does not climb onto the ladder from the side; providing grasping devices at the upper landing to assist in mounting and dismounting the ladder; placing the ladder at an angle one-quarter the working length of the ladder. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
