29 CFR 1926.52(d)(1): In all cases where the sound levels exceed the values shown herein, a continuing, effective hearing conservation program shall be administered.         a.  An employee was exposed to continuous noise levels at 261% of the allowable 8-hour time weighted average sound level (90dBA) while cutting concrete with a partner saw during renovation operations .  A continous noise level of 261% is approximately equivalent to 96.92 dBA.  The sampling was performed for 395 minutes during one shift on June 3, 2011.  Zero exposure was assumed for the unsampled period of time, 85 minutes.    An effective hearing conservation program which included monitoring of employee noise exposure, baseline and annual audiometric testing of employees and record keeping was not instituted by American concrete Restorations, Inc, when employee exposure to noise exceeded TABLE D-2 - PERMISSIBLE NOISE EXPOSURES.

29 CFR 1910.134(d)(1)(iii): The employer shall identify and evaluate the respiratory hazard(s) in the workplace; this evaluation shall include a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form. Where the employer cannot identify or reasonably estimate the employee exposure, the employer shall consider the atmosphere to be IDLH.    a.  On or about August 16, 2011, at the above addressed jobsite, an employee cutting concrete bridge supports was exposed to the hazards associated with silica due to the employer's failure to evaluate the respiratory hazards(s) at the worksite. The employees exposure measured 39 million partials per cubic feet (mppcf), approximately 1.4 times the permissible exposure limit (PEL) of 28 mppcf.    b.  On or about August 26, 2011, at the above addressed jobsite, an employee cutting concrete bridge supports was exposed to the hazards associated with silica due to the employer's failure to evaluate the respiratory hazards(s) at the worksite. The employees exposure measured 51 million partials per cubic feet (mppcf), approximately 1.8 times the permissible exposure limit (PEL) of 28 mppcf.
