29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; this evaluation shall include a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form. Where the employer cannot identify or reasonably estimate the employee exposure, the employer shall consider the atmosphere to be IDLH.    a) Grunwell-Cashero Co. - Toledo, Ohio: On or about June 23, 2011, the employer failed to evaluate employees for overexposures to silica while grinding brick mortar. Employees were exposed to hazards from silica, including silicosis and lung cancer.    b) Grunwell-Cashero Co. - Toledo, Ohio: On or about June 28, 2011, the employer failed to evaluate employees for overexposures to silica while grinding brick mortar. Employees were exposed to hazards from silica, including silicosis and lung cancer.    Grunwell-Cashero Co. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection #313785826, Citation #2, Item #4 and was affirmed as final order on January 19, 2011, with respect to a workplace located at 33687 Lake Road, Avon Lake, Ohio.
