29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b)( or (c) of this section:    a)  Employees were not protected from cave-in hazards while working within an excavation having a depth of approximately 6.5ft.    Berger Excavating Contractors, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 314815542, citation 01, item 003 and was affirmed as a final order on September 23, 2010, with respect to a workplace located at 115 Palatine Road in Palatine, Illinois  60067.    **No abatement certification or documentation is required for this item.**
