29 CFR 1926.451(g)(1): \r\n\r\nEach employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected fromfalling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employeeson each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs,and other elevated surfaces are set forth in subpart M of this part:    On or about 7/20/11 during construction activities including but not limited to working from a mobile scaffold, the employer did not ensure employees were protected from fall hazards approximately 12 feet. Employees were observed climbing the guardrails to access a roof canopy to install windows with no fall protection system.

Each employee on a walking/working surface (horizontal and verticalsurface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrailsystems, safety net systems, or personal fall arrest systems:    On or about 7/20/11 during construction activities including but not limited to working on a roof canopy with unprotected sides and edges, the employer did not ensure employees were protected from fall hazards approximately 12 feet. Employees were observed working on a roof canopy to install windows with no fall protection system.

29 CFR 1926.501(b)(14): \r\n\r\n\"Wall openings.\" Each employee working on, at, above, or near wall openings (including those withchutes attached) where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wallopening is less than 39 inches (1.0 m) above the walking/working surface, shall be protected from falling by the use of a guardrail system, a safetynet system, or a personal fall arrest system:    On or about 7/20/11 during construction activities including but not limited to working on a roof canopy with wall openings, the employer did not ensure employees were protected from fall hazards approximately 12 feet. Employees were observed working on a roof canopy to install windows with no fall protection system.
