29 CFR 1926.100(a):  Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.    A.  Grunwell-Cashero Co. worksite located at 400 N. Superior, Toledo, Ohio: On or about July 13, 2011, the employer did not ensure employees wore hard hats while erecting welded frame scaffold on the roof to access the working area to perform tuck pointing. An employee was exposed to falling material and tools.

29 CFR 1926.451(g)(1)(vii):  For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of thissection, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4)of this section.    A. Grunwell-Cashero Co. worksite located at 400 N. Superior, Toledo, Ohio: On or about July 13, 2011, the employer did not ensure employees were protected from fall hazards while working on the tubular welded frame scaffold located on the roof of the structure. Employees were exposed to a fall hazard up to 24.00 feet while working on the scaffold system.    A. Grunwell-Cashero Co. worksite located at 400 N. Superior, Toledo, Ohio: On or about July 14, 2011, the employer did not ensure employees were protected from fall hazards while working on the tubular welded frame scaffold located on the roof of the structure. Employees were exposed to a fall hazard up to 24.00 feet while working on the scaffold system.    Grunwell-Cashero Co. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(ii), which was contained in OSHA inspection number 313785826, citation number 1, item number 3 and was affirmed as a final order on January 19, 2011, with respect to a workplace located at 33687 Lake Rd., Avon Lake, OH.
