29 CFR 1910.147(f)(3)(ii)(D):  Each authorized employee did not affix a personal lockout or tagout device to the group lockout device, group lockbox, or comparable mechanism when he or she began work:      (a)	RMF Nooter, Inc., 915 Matzinger Road, Toledo, Ohio:  On or about July 5, 2011, at the worksite located at 1819 Woodville Road, Oregon, Ohio, the employer did not ensure that employees working on or near vessel R-8303, in Unit #8, at the Toledo Refining Company facility, placed personal locks on a group lockbox or comparable mechanism.  The energy sources to the vessel were locked out of service but employees worked while only a company lock and a supervisor lock were on the group lockbox.  Individual locks were not used.

29 CFR 1910.252(a)(2)(vi)(C):  Cutting or welding were permitted in the presence of explosive atmospheres:      (a)	RMF Nooter, Inc., 915 Matzinger Road, Toledo, Ohio:  On or about July 5, 2011, at the worksite located at 1819 Woodville Road, Oregon, Ohio, the employer did not ensure that welding was prohibited in an area where an atmosphere of flammable gasses was present.  A flash fire occurred when employees welding near vessel R-8303, in Unit #8, ignited flammable gasses leaking from a blind flange.

29 CFR 1910.252(a)(2)(xiv)(B):  The Supervisor did not determine the combustible materials and hazardous areas present or likely to be present in the work location.    (a)	RMF Nooter, Inc., 915 Matzinger Road, Toledo, Ohio:  On or about July 5, 2011, at the worksite located at 1819 Woodville Road, Oregon, Ohio, the employer did not ensure that the crew supervisor determined what combustible materials were present or likely to be present in the workplace.  Employees were at risk of serious burn and smoke inhalation injuries when two fires occurred from welding activities in Unit #8, vessel R-8303, due to the presence of combustible materials.
