29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:\r\n\r\n(a) DRS Construction at Dump Road, Edgeley, ND, on and before August 1, 2011, the exposing employer did not ensure employees were instructed in the recognition and avoidance of unsafe conditions associated with the use and operation of the Grove Manlift AMZ 66XT aerial lift. The employer did not effectively instruct employees in safe procedures related to not exposing any part of the body while raising or lowering the platform. On July 21, 2011, an employee working from the platform of the aerial lift had his head pinned between the top rail of the guardrail system on the aerial lift and the bottom chord of a truss within a pole barn.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:\r\n\r\n(a) DRS Construction at Dump Road, Edgeley, ND, on and before August 1, 2011, the exposing employer did not ensure individuals working from the AMZ 66XT, articulating boom aerial lift, were protected from falling from the basket by body harness with a lanyard attached to an anchorage point in the basket. Abatement note to paragraph (b)(2)(v): As of January 1, 1998, Subpart M of this part [1926.502(d)] provides that body belts are not acceptable as part of a personal fall arrest system.
