OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to fall hazards:    a) On or about August 9, 2011 and times prior, employees were exposed to serious injuries, in that, the wire rope attachments used as an anchorage for the lifeline were not engineered or evaluated to determine their capacity. This condition was found on the north leg head on the east roof and on the flat storage roof.    Abatement Verification: Abatement certification and documentation is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides:    a) On or about August 9, 2011 and times prior, employees were exposed to injuries from falls to the lower surface at the following locations:              1)	South area of the receiving pit lower platform was missing the upper and mid guard rails;            2)	North step landing area was missing the mid guard rail;            3)	North leg head, when accessing the platform to grease the bearing was missing guard rails;            4)	Flat storage northwest roof area platform was missing its guard rails;            5)	Flat storage north to south access platform was missing mid guard rail.    Abatement Verification: Abatement certification and documentation is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.219(d)(1):  Pulleys, any part of which are seven (7) feet or less from the floor or working platform, were not guarded in accordance with the standards specified in paragraphs (m) and (o) of this section:    a) On or about August 9, 2011 and times prior, employees were exposed to injuries from unguarded pulleys at the following locations:              1)	North leg head, ventilation fan;              2)	South head house, head pulley;              3)	Flat storage northwest roof area, 2 drive motors.
