29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    a)	Roof Check, Inc. at 4393 Hayler Ave., Loveland, CO 80534:  On 9/26/11, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person.  Employees on-site were permitted to work in areas where fall hazards existed. The condition exposed the employees to a fall hazard of approximately 16 feet.    Roof Check, Inc. was previously cited for a violation for substantially similar condition of this Occupational Safety and Health Standard or its equivalent standard (29 CFR 1926.20(b)(2)) which was contained in OSHA inspection number 313420176, Citation number 2, Item number 1, issued on 9/15/10 and became Final Order on 10/9/10 with respect to a workplace located at 15317 E. 101st Pl., Commerce City, CO 80013. A second OSHA inspection number 313413924, Citation number 1 Item number 1, issued on 11/10/09 and became Final Order on 11/30/09 with respect to a workplace located at 2032 Widgeon Dr., Johnstown, CO 80534.     Abatement Note: OSHA defines a competent person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them.
