29 CFR 1910.23(c)(1):  Open-sided floors or platforms 4 feet or more above adjacent floor or ground levels were not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder:  (a)  Transervice Logistics Inc. at 10251 E 51st Ave, Denver, CO 80239:  Before September 30, 2011, the employer did not ensure open-sided platforms that were 4 feet or more above ground levels were guarded by a standard railing or the equivalent, in that employees fueling the 2,500 gallon tank on top of fuel truck #990 were exposed to a fall hazard of approximately 8.5 feet. The working platform did not have guardrails installed on all sides, thus exposing employees to fall hazards.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard in the workplace:    (a)  Transervice Logistics Inc. at 10251 E 51st Ave, Denver, CO 80239:  On and before September 30, 2011, the employer did not identify and evaluate the respiratory hazard in the workplace, in that employees were potentially exposed to the inhalation of diesel fuel fumes while refueling the 2,500 gallon tank on fuel truck #990. To perform this task employees bend down to open the hatch on top of the tank, and then insert a hand-operated fuel nozzle. This condition potentially exposes employees to the hazards of inhalation of harmful fumes.
