29 CFR 1910.1027(k)(1): Surfaces were not maintained as free as practicable of accumulations of cadmium: (a) Brazing room: Wipe sample results indicate surfaces such as the applicator machine, spreader, and syringe of brazing paste were contaminated with cadmium. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a)The employer did not develop or implement a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following: 1) Requirement for labeling of containers of hazardous chemicals; 2) Material safety data sheet availability; 3) Training of employees; 4) A complete list of hazardous chemicals known to be in the workplace; 5) Methods to inform employees of the hazards on non-routine tasks; and 6) Methods to inform other employer(s) of material safety data sheet availability; the labeling system; and any precautionary measures to protect employees. Employees were exposed to hazardous chemicals, including cadmium, copper, zinc, cadmium metal oxide and hydrofluoric acid fumes when brazing paste is heated to decomposition temperatures. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.1200(h)(3)(ii): Employee training did not include the physical and health hazards of the chemicals in the work area: (a) Employees performing brazing operations with and without cadmium were not trained on the hazards associated with the brazing paste. Brazing paste used by employees contains: boric acid, silver, copper, zinc and cadmium. During the brazing process, the paste is heated to its melting point which produces hazardous decomposition products, such as, carbon monoxide, copper fumes, zinc oxide fumes, tin oxide fumes, cadmium oxide fumes and hydrofluoric acid. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent. (a) BIC Manufacturing Inc. - On or about October 14, 2011, the employer did not use OSHA 300 and 301 forms or equivalent forms for recording injuries and illnesses for the calendar year 2011. On or about August 1, 2011, an employee sustained a head laceration requiring stitches. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
