29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employees noise exposures equaled or exceeded an 8 hour time-weighted average sound level (TWA) of 85 dBA:    Employees, performing pallet assembly, were found to be in excess of the action level for noise and the employer had not implemented an effective hearing conservation program.    a. Employee 1 was exposed to continuous and intermittent noise at 205.9% of the action level or an equivalent sound level of approximately 95.2 dBA during the 330 minute sample period.    b. Employee 2 was exposed to continuous and intermittent noise at 178.6% of the action level or an equivalent sound level of approximately 94.2 dBA during the 310 minute sample period.    c. Employee 3 was exposed to continuous and intermittent noise at 203.6% of the action level or an equivalent sound level of approximately 95.1 dBA during the 345 minute sample period.    d. Employee 4 was exposed to continuous and intermittent noise at 180.1% of the action level or an equivalent sound level of approximately 94.2 dBA during the 330 minute sample period.    e. Employee 5 was exposed to continuous and intermittent noise at 145.1% of the action level or an equivalent sound level of approximately 92.7 dBA during the 330 minute sample period.
