29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. Entire Facility - On or about January 6, 2012, the following powered industrial forklift trucks were not removed from service. 1. Clark #5 -serial # 0297880KOF - horn not operative 2. Clark serial # GX127E0078-9345 - horn not operative 3. Hyster #12 & #21 - lights not operative 4. Hyster #13 - tires worn excessively
