29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):    (a)  American Civil Constructors at Hwy 119 & South Main Street, Black Hawk, CO 80422:  On February 23, 2012, the exposing employer did not ensure that each employee working inside an excavation, that was approximately 8 feet in depth, was protected from cave-in. Three employees accessed a ladder on the south side of the excavation in order to work on a manhole structure that was located in the center of the excavation. The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i), in that the maximum allowable slope associated with Type C soil and an angle of 34 degrees, from toe to top. The north, west, and south sides of the excavation were sloped at approximately 45 degrees. This condition exposed the employees to a crushing hazard by excavation wall cave-in.    American Civil Constructors was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.652(a)(1) which was contained in OSHA Inspection Number 312136641, Citation Number 1, Item 1 issued on October 10, 2008, and became Final Order on November 15, 2008, with respect to a workplace located at North Nevada and Eagle Rock Rd., Colorado Springs, CO 80906.
