A) Worksite - On or about March 21, 2012, an employee was cutting lumber with the DeWalt Model DW368 circular saw and was not wearing eye protection to protect himself from flying wood chips.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. A) Worksite - On or about March 21, 2012, an employee, who had been installing plywood sheets on the roof, crawled down a rafter to access the second floor from the roof. The employee was not using fall protection and was exposed to a fall hazard. B) Worksite - On or about March 21, 2012, two employees were not using fall protection while installing the fascia on the roof. C) Worksite - On or about March 21, 2012, employees working on the second floor near window openings were exposed to fall hazards since guardrails were not installed across the openings. D) Worksite - On or about March 21, 2012, employees accessing the second floor via ladder were exposed to a fall hazard to the basement since guardrails were not installed around the stairwell openings on the first and second floors. Wm Horwedel LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 311977748, citation number 1, item number 4 and was affirmed as a final order on May 11, 2009, with respect to a workplace located at Everson Way Ballston Spa, NY.
