OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck-by:    a)  19440 Judson Rd, San Antonio, TX,  Rebar cut area:  On or about 03/15/2012, and at times prior thereto, employees were exposed to a struck-by hazard while operating a Demag 10 Ton Overhead Hoist, S/N 85864 with a missing latch hook.      b)  19440 Judson Rd, San Antonio, TX,  Rebar cut area:  On or about 03/15/2012, and at times prior thereto, employees were exposed to a struck-by hazard while operating a Demag 10 Ton Overhead Hoist, S/N 85864 without conducting frequent and periodic inspections of the underhung overhead hoist, including the running rope.      c)  19440 Judson Rd, San Antonio, TX,  Rebar cut area:  On or about 03/15/2012, and at times prior thereto, employees were exposed to a struck-by hazard while operating a Demag 10 Ton Overhead Hoist, S/N 85864 with the control pendant was not properly labeled.
