29 CFR 1910.178(l)(1)(i):     The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    a.     On the site where the employer used a powered industrial truck to lift shhets of plywood to the roof and was not trained in the safe operation of the poered industrial forklift thereby exposing employees to a struck-by hazard.

At the front of the house there were three synthetic slings used to raise trusses which were badly frayed and torn thereby exposing employees to a struck-by hazard.

29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provisionin paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it isinfeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets therequirements of paragraph (k) of 1926.502.Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fallprotection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complieswith 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    a.     On the backside of the roof where employees were installing plywood sheeting on a 9/12 pitch roof, a fall protection system was not provided or enforced to be used thereby exposing employees to a fall hazard.

29 CFR 1926.1052(c)(1)(ii):     One stairrail system along each unprotected side or edge.Note: When the top edge of a stairrail system also serves as a handrail, paragraph (c)(7) of this section applies.    a.     In the residential house, the stairway from the first floor to the second floor did not have a handrail on either side thereby exposing employees to a fall hazard.

29 CFR 1926.1053(b)(1):     When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder.  In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.    a.     At the rear of the second floor where employees were using a six foot step ladder to gain access to the trusses to gain access to the roof, the ladder did not extend three feet above the landing point thereby exposing employees to a 9 foot step ladder.    b.      At the front of the second floor where employees used a 6 foot step ladder to gain access to the rafters to install trusses the ladder did not extend three feet past the landing thereby exposing employees to a fall hazard.
