OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees    At the site, and locations through out the facility, two Hyster fork lifts were being utilized by various employees at the site in the moving of material to various locations. Both forklifts were missing the operator restraint systems. These system, in conjunction with the roll over protective structures help to protect employees in the event of roll over or vehicular tilt.
