29 CFR 1910.23(a)(5): Every pit and floor opening was not adequately guarded by standard railing or any other effected means. At the site,Inside Building 1 the plate roller machine utilized a hinged gate on its west side that did not adequately cover the area required by the machine to move back and forth during the change out of plates after being formed. The area left unprotected was located on the north side of the positioning arm for the machine.

29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: At the site, employees were entering into vessels to perform welding and cutting work as part of the preperation and finishing work. The employer did not have job specific entry procedures for the employees performing this work.

29 CFR 1910.178(a)(4): Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: At the site, a fork lift used on the east side of the facility was equppied with employer fabricated forks with a length of approximately 7 feet. These forks were not the forks that came standard with the fork lift from the manufacturer. The longer forks were intended to help with loading and unloading of more equipment and with vessels being fabricated at the facility.

29 CFR 1910.253(b)(2)(ii): Assigned storage spaces for cylinders was not located away from elevators, stairs, or gangways where cylinders could not be knocked over or damaged by passing or falling objects, or subject to tampering by unauthorized persons: At the site, cylinders used for various cutting and welding operations were not stored in such a manner as to keep them from falling over and possibly become projectiles. a) Unsecured cylinder (48"/122 cubic feet compressed air) was located in bay 2, near the wleding station of an emloyee. b) Unsecured cylinder was located in bay 1 (48"/122 cubic feet compressed air), near overhead welding station. c) unsecured cylinder (36"/80 cubic feet Argon) near welders personal work area and grinding station.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees At the site, and locations through out the facility, two Hyster fork lifts were being utilized by various employees at the site in the moving of material to various locations. Both forklifts were missing the operator restraint systems. These system, in conjunction with the roll over protective structures help to protect employees in the event of roll over or vehicular tilt.
