29 CFR 1910.134(e): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit-tested or required to use the respirator in the workplace:     (a) On or about 04/13/2012, for employee working on Calender #1, who wears a 3M 8511 N95 particulate respirator when cleaning the dust box. Using a respirator may place a physiological burden on employees that varies with the type of respirator worn, the job and workplace conditions in which the respirator is used, and the medical status of the employee.

29 CFR 1910.134(g)(1)(i)[A]:  The employer permited respirators with tight-fitting facepieces to be worn by employees who have facial hair that comes between the sealing surface of the facepiece and the face, or that interferes with valve function:    (a) On or about 04/13/2012, at establishment, for an employee working in spreading and milling who is periodically exposed to toluene and particulate. Employee has a beard that would hinder a tight-fit and allow air contaminants to be inhaled.
