OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential falling of overhead hydraulic automobile lifts on the following lifts: a) Automotive Lifts & Machinery Corp (ALM) Lift; Model 7001, #206-01403, left side, Lower Bay 1) The two front swing arm safety locks are broken. 2) One of the two hand controls was overridden, so that only one of the two controls had to be pushed to operate the lift. b) Automotive Lifts & Machinery Corp (ALM) Lift; Model 7001, #206-01401, right side, Lower Bay 1) The two driver's side swing arm safety locks are broken. 2) The safety catch, intended to stop the lift from falling in the event of a catastrophic failure of the hydraulic system, was overridden because the safety catch would not disengage and allow the lift to be used. 3) The compressed air conainer for the safety catch was leaking. c) VBM Automotive Lift; Challenger, Model 3100, #314718, Upper Bay, nearest to Lower Bay 1) The equalizer cable is out of synchroniztion causing the lift to raise unevenly, the lower side being on the driver's side. Among other methods, one fesible and acceptable abatement method to correct these hazards is to comply with the American National Standards Institute, Automotive Lift Institurte Standard for Automotive Lifts- Safety Requirements for Opertions, Inspection and Maintenance, 2008.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to a fall hazard of 18 feet while riding a pallet raised by a fork lift. Among other methods, one feasible and acceptable abatement method to correct these hazards is to not use the fork lift in a way for which it was not designed. Personnel platforms with fall protection are required to be used according to manufacturer specifications with manufacturer approval. Equipment is to be made available to employees which would provide a safe manner in which to retrieve parts at heights in the warehouse shelving units.
