OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to struck-by / caught-between hazard(s) from "kick-out" of trees during felling operations.      Condition(s) noted on or about 5/4/2012.      Among the feasible and recognized means of hazard control is to notch and back-cut larger (>5" dia at chest height) tree trunks in accordance with published Safety Requirements for Arboricultural Operations (ANSI Z133.1 - 2006, Section 8.5.14 and 8.5.15).
