29 CFR 1926.501(b)(13):     Each employee engaged in residential construction activities six (6) feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer develop and implement a fall protection plan that meets the requirements of paragraph (k) of 1926.502:    On May 17, 2012, at a jobsite located at 6623 Forney Branch, Dallas Texas; where at least two employees walking/working on the top-plate above 6-feet were not protected from falling to the lower level.    THE EMPLOYER, ROBERTO BADILLO WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.501(b)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 314185489, CITATION NUMBER 1, ITEM NUMBER 2 AND WAS AFFIRMED AS A FINAL ORDER ON 01/23/2012, WITH RESPECT TO A WORKPLACE LOCATED AT 8779 SHERWOOD DRIVE, FRISCO, TEXAS 75040.
