29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: On or about June 27, 2012, at the job site employees were observed working from an extensible boom lift platform approximately 33 feet high to the ground. The employees were not wearing fall protection equipment while in the boom lift platform. The employees were exposed to fall hazards.

CFR 1926.1412(d)(2): The equipment was not taken out of service if any deficiency in paragraphs (d)(1)(i) through (xii) of this section (or in additional inspection items required to be checked for specific types of equipment in accordance with other sections of this standard) was identified and determined to constitute a safety hazard by a competent person. On or about June 27, 2012, at the jobsite a 30-ton mobile crane was observed being used to lift heavy object while hydraulic fluid was leaking. Employees were exposed to the hazards that may cause by the malfunction of the hydraulic systems.
