29 CFR 1910.119(j)(5): Equipment deficiencies. The employer shall correct deficiencies in equipment that are outside acceptable limits (defined by the process safety information in paragraph (d) of this section) before further use or in a safe and timely manner when necessary means are taken to assure safe operation. -in the alternative- 29 CFR 1910.119(d)(3)(ii):The employer shall document that equipment complies with recognized and generally accepted good engineering practices. A)This condition was most recently observed at Lion Copolymer in Geismar, LA, when the employer did not correct deficiencies in the Poly-2 Unit. THe employer identified the need for pressure relief protectionon the MERCO filters, but failed to correct the deficiencies in a timely manner or implement interim measures until such time that the equipment deficiencies could be adequately corrected. No relief protection on MERCO filters B)This condition was most recently observed at Lion Copolymer in Geismar, LA, when the employer did not correct deficiencies in the Poly-3 Unit. Pressure relief devices, which have excessive inlet pressure drops, excessive pressure drops and oversized orifice sizes, and is outside acceptable limits defined by design codes, inconsistent with recognizeds and generally accepted good engineering practices. The following are PSVs found to have the referenced deficiencies in the Poly-3 Unit: 91-PSV-7869 91-PSV-6134 C)This condition was most recently observed at Lion Copolymer in Geismar, LA, when the employer did not correct deficiencies in the Trilene Unit. Pressure relief devices, which have excessive inlet pressure drops, excessive pressure drops and oversized orifice sizes, and is outside acceptable limits defined by design codes, inconsistent with recognizeds and generally accepted good engineering practices. The following are PSVs found to have the referenced deficiencies in the Trilene Unit: 95-PSV-5310 95-PSV-4266 95-PSV-5423

29 CFR 1910.119(j)(6)(ii):Appropriate checks and inspections shall be performed to assure that equipment is installed properly and consistent with design specifications and the manufacturer's instructions. This condition was most recently observed at Lion Copolymer in Geismar, LA in the Recovery Unit, when the employer operated the Goulds RP-11B and RP-11C Pumps (Model 3935) without proper installation. Both pumps had bolts missing form the footing which is not consistent with design specifications and manufacturer's instructions.

29 CFR 1910.119(l)(5):If a change covered by this paragraph results in a change in the operating practices required by paragraph (f) of this section, such procedures or practices shall be updated accordingly. This condition was most recently observed at Lion Copolymer in Geismar, LA, when the employer adopted a practice of applying water to the Goulds Barrel Pumps (Model 3935) without a Management of Change. Water was being applied to the Catalyst Pumps in the recovery area, which would prevent the pumps from fouling and cavitation.
