Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment that was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards due to missing safety latches on hooks used overhead gantry cranes: a) For the Lotts Concrete Products, Inc. facility at 429 N. Hennis Rd., Winter Garden, FL 34787, as observed on or about 07/27/2012, hooks and chains were used with overhead gantry cranes to lift troughs into which wet concrete was poured. No safety latches were present on the hooks used to lift the troughs. The troughs were in danger of sliding out of the hooks at the hook connection point as observed on site.

Hennis Rd., Winter Garden, FL 34787, as observed on or about 07/27/2012: employees were exposed to laceration/puncture hazards or eye injuries associated with compressed air that was conveyed through PVC piping in the fabrications shop and at the compressors where employees work or performed maintenance. PVC air lines were observed to be leaking and line pressures were 110 psi.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) For the Lotts Concrete Products, Inc. facility at 429 N. Hennis Rd., Winter Garden, FL 34787, as observed on or about 07/27/2012, maintenance was performed on various pieces of equipment, as needed around the facility, and no lock out tag out program was in place to address safe procedures for de-energizing equipment that was being worked on. Hazardous energy was present in the form of mechanical energy from the rotary mixer, hydraulic and pneumatic energy from the pre-cast concrete form pouring machines and other equipment used, as well as electrical energy in the form of 240V and gravitational potential energy from heavy machinery such as pre-cast conveyor chains weighing hundreds of pounds.

Hennis Rd., Winter Garden, FL 34787, as observed on or about 07/27/2012, employees were exposed to laceration, crushing, or amputation hazards associated with the point of operation of the following equipment used on site: a) Laceration hazards were present at a horizontal metal band saw that was used periodically to cut metal pieces in the fabrications shop. No adjustable blade guard was present on the saw. b) Employees were exposed to hand or arm crushing hazards while operating hydraulic pre-cast concrete form pouring machines during the operating cycle when the pre-cast piece was pressed onto the curved mold. c) Employees were exposed to potential broken bones or finger amputations at the point of operation associated with an unguarded rebar shear into which employees could stick their fingers while operating the foot pedal.

Oxygen and fuel gas were used at the facility for torching and welding and stored in two locations: a) In the fabrications shop, acetylene gas cylinders were stored with oxygen gas cylinders b) In the yard, a 4000 5000 cubic feet capacity oxygen cylinder was stored next to a propane cylinder /tank. The propane and oxygen were used for torching off protruding rebar ends from the wet poured pre-cast concrete forms.

Equipment was located in multiple locations throughout the facility and was not right next to the electrical disconnects, and employees were confused as to what the function of all the electrical disconnects was.
