OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by tanker trucks and forklifts that operate on the yard and around the wash rack: a) On the yard and around the wash rack, on or about August 9, 2012 and at times prior to, employees who wore dark colored clothing were required to walk and work on the yard and around the wash rack where tanker trucks and forklifts operated, resulting in a struck-by hazard.
