29 CFR 1926.651(h)(1):     Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation. The precautions necessary to protect employees adequately vary with each situation, but could include special support or shield systems to protect from cave-ins, water removal to control the level of accumulating water, or use of a safety harness and lifeline.    On or about August 14, 2012 at the jobsite located at the intersection of North Oak Trafficway and 69th Street in Gladstone MO, employees were exposed to an engulfment hazard in that while working in an excavated trench at a depth of approximately 8 feet there was water accumulated in the bottom of the trench and employees were working in it.  No precautions had been taken to protect workers from the hazards of the accumulation of water in the trench.
