OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while working from a personnel platform that was elevated with a forklift: a) In the building, on or about August 29, 2012 and at times prior to, employees used a personnel platform that was attached to a Komatsu FG20ST forklift to access elevated work, which was not permitted by the forklift manufacturer, resulting in a fall hazard.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent): a) At the A and B tanks in the production area, on or about August 29, 2012 and at times prior to, standard railings were not installed around the access platforms. A thirty-eight inch high top railing and no mid-railing surrounded the platforms, resulting in an eight and a half to twelve-foot fall hazard. b) At the loading dock on the west side of the building, on or about August 29, 2012 and at times prior to, standard railings were not installed at the dock, resulting in a 50 fall hazard.

Other areas of the building that contained an office, a production area, shipping and receiving areas, as well as a hydrogen peroxide storage area were not cut off by a standard fire wall from the methanol storage area, resulting in a fire hazard.
