OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    On or about October 2, 2012, at Building #2, on the Chicago Press Brake, Serial # L 9170, the foot treadle controller was not unguarded to prevent the unintended machine actuation of the press by the inadvertent stepping on the treadle or having material drop onto the treadle.

29 CFR 1910.219(b)(1):     Flywheel(s) with parts seven feet or less above floor(s) or platform(s) were not guarded in accordance with the requirements specified in 29 CFR 1910.219(b)(1)(i) through (b)(1)(iv):    a)	 Building #3, on the V & O, 10 ton full revolution press, the flywheel was not completely enclosed.  It had a 1.5 inch wide, 17 inch long opening in the guard at the front.    b)	Building #3, on the Benchmaster 2 ton press, Model Number I52L, Serial Number 42788, the flywheel was not guarded on the front half.    c)	Building #3, on the Benchmaster 2 ton press, Model Number 10/30D, the flywheel was not guarded on the front half.    d)	Building #1, on the Loshbough, 35-40 ton press, the flywheel was not guarded on the front half.    e)	Building #1, on the Benchmaster wire cut off machine, the flywheel was not guarded on the front half.    f)	Building #1, on the Loshbough, 35-40 ton press, the flywheel was partially guarded on the rear half.
