OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees performed work from an aerial lift on an inadequate surface and support which did not withstand all load forces imposed by the aerial platform in all operating configurations. On or about November 5, 2012 and times prior thereto, an employee of BHN, Inc. worked from an articulating boom JLG 800A (serial #: 111922 0300047730) aerial lift installing screws into a pressure bar on the 6th story exterior window of the NEA Baptist Health System Hospital and Clinic being constructed at 4800 East Johnson Avenue in Jonesboro, Arkansas. The employee operated the aerial lift at an approximate working height of 60 feet while positioned on a wooden platform placed on unleveled ground for support. The surfaces which the aerial lift was used was inadequate and did not withstand all load forces imposed by the aerial lift in all operating configurations, exposing the employee to a fall of approximately 60 feet to the ground level below.
