29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. a. Storage Area above management's offices - On or about December 13, 2012, employees were required to access a storage area above an office to store card board boxes. The storage area was 10 ft. 9 inches above ground and did not have a standard guardrail system. Employees were thereby exposed to fall hazards. b. Clarifier Area/Eastside - On or about December 13, 2012, employees were required to perform waste water treatment operations from a catwalk that did not have a standard guardrail system. The catwalk was missing its midrail and its toeboard. Employees were thereby exposed to fall hazards.

29 CFR 1910.151(c): Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use. [63 FR 33450, June 18, 1998] a. First Floor/Production Areas - On or about December 13, 2012, employees required to work with corrosive chemicals, such as but not limited to caustic soda, hydrochloric acid, phosphoric acid, sulfuric acid, were not provided with an eye wash station or a functioning eye was station. The deficiencies found regarding eye wash stations and their locations were the following; 1. At the waste water treatment area the eye wash station was inoperable (no water available). 2. The chemical storage area/transferring chemical area did not have an eye wash station.

By the employee's lunch room - On or about December 13, 2012, the employer had work surfaces that were not maintained as free as practicable of accumulations of chromium (VI) in all forms. These work surfaces were the following; 1. The top surface (wipe sample # 50) of the table in the lunch room contained 0.0902 micrograms per 10 square centimeters of area of chromium (VI) and 0.1735 micrograms per 10 square centimeters of area of chromic acid and chromates (CrO3). 2. The top surface (wipe sample # 7) of the barbecue table outside the lunch room contained 0.0605 micrograms per 10 square centimeters of area of chromium (VI) and 0.1163 micrograms per 10 square centimeters of area of chromic acid and chromates (CrO3).
