29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects. For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall. 29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. (a) Jobsite located at Boccella Precast LLC, 322 New Brooklyn Road: An access ladder was not provided to employees who worked on the 3rd and 4th level of the scaffold. Employees used an extension ladder to access the second level and then climbed the scaffold to get to the higher levels, observed on or about 12/6/12. (b) Jobsite located at Boccella Precast LLC, 322 New Brooklyn Road: An access ladder was not provided to employees working from the side bracket of the scaffold, the distance from the side bracket to the top platform exceeded 24 inches. Employees used the frames and cross braces to get to the platform, observed on or about 12/6/12. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

The scaffold had hand rails but was missing mid rails, observed on or about 12/6/12. (b) Jobsite located at Boccella Precast LLC, 322 New Brooklyn Road: Employees were working on the side bracket located on the 4th level of the scaffold without the use of end rails, observed on or about 12/6/12. (c) Jobsite located at Boccella Precast LLC, 322 New Brooklyn Road: Employees were walking on the 3rd level the scaffold system that was not provided with guardrails, observed on or about 12/6/12. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
