OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by and crushed by a pay loader when the machine was operating in reverse. a) 482 Mill Rd, Coram N.Y. (worksite) material yard, mulch processing area - The pay loader , Caterpillar model, serial # 972GKAWP00463, did not have an operable back-up alarm. In addition, the left side exterior rearview mirror was missing and the right side exterior rearview mirror was bent, on or about 12/14/12 Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
