29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:Note:  Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.    a) Better Baked Foods, LLC / 2200 East 38tth Street / Erie, PA: On or about February 27, 2013 the upper platform located in the back of the condensation tank in engine room 2 did not adequately protect employees from falls of up to approximately 12 feet.    b) Better Baked Foods, LLC / 2200 East 38tth Street / Erie, PA: On or about February 27, 2013 employees would access the top of the storage cage in engine room #1 to obtain materials and would be exposed to falls of greater than 6 feet.
